Generally, appeals to a Local Consent Authority Tree Removal Application refusal are subject to appeal within three months of determination, as a Class 2 appeal in the LEC.  Arborgenesis can assist in preparation and provide tree advice for these appeals. Where a tree is subject to a heritage DA, review of the determination is under section 82A, 82B and 96AB of the Environmental Planning and Assessment Act, where our expert witness service are available. 

Class 5 proceedings are criminal enforcement proceedings, where government authorities can pursue prosecuting offences against planning or environmental laws. During this complicated process, Arborgenesis can provide advice on the tree related matters, assist in the preparation of documentation, attend site investigations, and outline the other experts required to successfully pursue a prosecution in the LEC by a Local Authority.

Including drafting of comments that take into consideration relevant Acts, SEPP's, LEP's, and DCPs providing realistic and informed Arboricultural and tree advice. We can also assist in the drafting of relevant conditions of consent for the protection of trees during and after development.

Arborgenesis has experience in the assessment of State Significant Development and Infrastructure projects. We also assist Local Authorities in the drafting of relevant conditions for submission to State Authorities during the SEARs, EIS, Assessment, and determination phases. We also work with proponents to prepare Arboricultural assessment for submission to State Authorities.
